Officially you need permission I think. The fact that you change the base material is sooner a violation of rights than a way to absolve you LOL.

You buy the right to play a track for personal use. Any performance of the track and or distributing it in ANY way, shape or form usually revokes the rights granted to you by purchasing the track somewhere.

For every country it is different though, many organisations can sell you a “blanket” license to use stuff in public places or for projects or whatever. You’ll have to look into that one specifically for your own country.

In all honesty, I’d probably just do it since this is a student project that isn’t going to be put in theaters with tickets sold. I take it you’ll show it only to your class right?

The right way though would be to contact the artist, ask for and get permission, possibly pay royalties, and then give credit for the tune in your ending credits. Just remember that if you go beyond this. You also could look into royalty-free music.

However, if you’re worried, then email the artist. What can it hurt?

Well, if you don’t mail them, you can feign ignorance (better to ask for forgiveness than permission right) which is hard to do if they say no and you still stick the track in your movie.

Actually… if you are in the United States, you MAY be able to use it under the Fair Use laws… as a school project, it is for educational use, which is sometimes allowed under Fair Use.

I am not a lawyer, though, so… honestly, for just a student project I wouldn’t worry too much anyway – though if you upload it to YouTube, it could be susceptible to takedown orders.

    -umm…. i reside in india.
-this film shall be shown only to the students
-our school policy shall not allow uploading on youtube and other sites.
-since we r putting up an edit of the track and not the original, maybe we won’t have this big a hassle, right?
-@Vintage won’t the artists sue us? xD

Nah, there is nothing worth sueing for, unless your school is extremely rich (which I am betting it isn’t).
